Sky Warrior Bahamas Ltd. (operating, together with certain affiliates, as Baha Mar (collectively, “Baha Mar”, “we”, “our” or “us”) is committed to protecting the privacy and security of the information we collect and to being transparent about the ways in which we collect and process your information. This statement (the “Privacy Policy”) sets forth our policies and practices for handling the information we collect from or about you. It applies to the information collected through the services that include an authorized reference or link to this Privacy Policy (the “Services”). Services provided by our affiliated properties are governed by other policies. CTF BM Operations Ltd., operating as Baha Mar Resort (“Baha Mar Resort”), is an affiliate of Sky Warrior Bahamas Ltd., and their Privacy Policy can be found here.
I. COLLECTION OF INFORMATION
We may collect information about you and devices you use to access our Services in a variety of ways:
•You may provide information to us directly.
•We may collect information about you and your devices automatically, such as when you visit or use our Services or view our online ads.
•We may obtain information about you from affiliated companies like Baha Mar Resort.
•We may obtain information about you from third parties, including branded hotel companies for which we manage hotels and other properties (“Hotel Brands”).
In the twelve (12) months prior to this Privacy Policy taking effect, we collected the categories of information described below from these sources:
•Information you provide directly to us. Depending on your relationship with us, this may include:
- Contact information such as name, email address, postal address, and telephone number;
- Demographic information such as age, date of birth, education, profession, marital status, and gender;
- Billing and financial information such as your payment card number, expiration date, security code, and billing address;
- User account information such as username and password, account number when you use our gaming services, and loyalty account number when you sign up for Club Blu;
- Credit application information such as name and contact information, social security number, employment information, financial information, other lines of casino credit in your name, and other information provided in connection with your credit application if you apply for credit with us;
- Government-issued ID information such as your passport, driver’s license, or other government-issued ID;
- Reservation and folio information such as information about the type and price of hotel room booked and the use of hotel services (including, without limitation, any charges billed to your room);
- Travel itinerary details such as arrival and departure information, flight number and details, points of origin and destination, and group information;
- Preference information such as food and beverage preferences, dietary information, and special requests; and
- Other information we collect from you or infer based on the other information we have collected. For example, we may collect survey responses, communications you send us, and information you provide when you participate in promotions. It also may include information you share with us or those with whom we do business when you interact with us in person.
•Information we collect automatically. We collect internet or other electronic network activity information automatically from the devices and browsers that you use, including your device type; Internet protocol (IP) address; device and advertising identifiers, and other unique personal or online identifiers; time zone setting and location; browser type and version; browser plug in types and versions; operating system and platform; browser WIFI signal; Internet service provider; pages that you visit before and after using the Services, browsing history, and information about your interactions with our Services; the technology on the devices you use to access these Services; and standard server log information. In addition to the information described in the paragraph, we might automatically collect information when you register and use our Wi-Fi services at one of our properties, including the time, date, and location of registration, the websites you visit, information about your mobile carrier, your device identification number, bandwidth used, and session time.
•Information we collect from affiliates, third parties and other sources. We also receive the categories of information described above from other sources, including:
- Affiliates. For example, Baha Mar and Baha Mar Casino may share your information in connection with providing you complimentary benefits from Baha Mar Casino.
- Hotel Brands. If you make a reservation to stay at one of our properties, we will have access to your reservation and other personal information. Some of this information is maintained by the relevant Hotel Brand on its information systems, but we can access this information for the purposes described in this Privacy Policy.
- Social media activity. We collect information from social media activity such as when you follow us on social media sites like Facebook and Instagram.
- When you provide feedback or comments and communicate with us. We may collect information that you voluntarily share with us in surveys, guest feedback, as well as on third-party websites.

For example, we may collect health information in connection with relevant spa services or childcare services or in the event you need emergency or medical services. You may also disclose your religious affiliation to us when you host or attend an event at one of our hotels or provide certain dietary restrictions so that we can accommodate you during your stay. On-site medical services via Baha Mar’s clinic are operated by a third-party provider, Doctors Hospital, and its personnel also provide onsite EMT services throughout Baha Mar. Please refer to its privacy notice for more information about its privacy practices.
II. USE OF INFORMATION AND PURPOSE OF DATA PROCESSING
We may use the information we collect for the purposes and, where applicable, on the lawful bases set out below:
•Providing you with services, including managing your reservations and bookings and otherwise working to provide you with products and services, and making your visit at our properties as enjoyable as possible;
•Managing our communications with you including to send you information about the Baha Mar Resort and services available to you;
•Responding to you and providing support including to address your inquiries and feedback, requests, and other communications you send us, and provide you with guest support services;
•Marketing including to present or send you messages, news, and other types of information about offers, promotions, and events that may be of interest to you;
•Operating, evaluating, and improving our business including to perform accounting, auditing, record keeping, and other internal functions (such as ensuring the functioning, safety, and security of our premises, infrastructure, and networks), developing new products and services, analyzing and improving our existing products and services, and personalizing the guest experience for you and others; and
•Prevention and protection purposes, including to protect our visitors, guests, patrons and employees, identify and prevent fraud and other unlawful activity, and protect and defend Sky Warrior Bahamas Ltd. and its affiliates, partners, and guests against legal claims and other liabilities.
III. DISCLOSURE OF INFORMATION
We are committed to maintaining your trust, and we want you to understand when and with whom we may disclose the categories of information we collect.
•Authorized third-party vendors and service providers. We use service providers, suppliers, and agents to help us provide our products and services and to perform services on our behalf (such as maintenance, IT services and support, advertising and marketing, data analysis and analytics, audit, payments, development, reservations, security, ID verification, and background and credit checks). We also may share information with those who do business with us (such as travel agencies, cruise lines, event organizers, and travel booking platforms) for the purposes described in this Privacy Policy.
•Our Affiliates. We may share your information with our affiliates and their service providers for the purposes described in this Privacy Policy, including in connection with providing you complimentary benefits from Baha Mar Casino and to provide you marketing communications with offers we believe will be of interest, consistent with your choices.
•Hotel Brands. We and our Hotel Brands work together to provide you a seamless stay at our properties. As a result, we make information accessible to our Hotel Brands, and each Hotel Brand’s use of the information is subject to its own privacy policy, which we encourage you to review.
•Health, Safety and Other Exigencies. We may disclose your information when handling accidents and medical and other exigencies. For example, we may need to disclose your information to third parties to facilitate medical care, assist with travel arrangements, or in the event of other exigencies.
•Business transfers. We may disclose your information in connection with a substantial corporate transaction, such as the sale of a website, a merger, consolidation, asset sale, initial public offering, or in the unlikely event of bankruptcy.
•Legal purposes. We may disclose your information to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims or government inquiries, and to protect and defend the rights, interests, safety, and security of us, our affiliates, partners, guests, or the public.
•With your consent or at your direction. We may disclose information for any other purposes disclosed to you at the time we collect the information or pursuant to your consent, or when it’s necessary to provide you with our products and services.
If you access third-party services such as social media services, these third-party services may be able to collect information about you, including information about your activity on the Services. Additionally, they may notify your connections on the third-party services about your use of their site, in accordance with their own privacy policies.
In the twelve (12) months prior to this Privacy Policy taking effect, we have not sold or shared your personal information for money. However, we may share information with our third-party vendors to do targeted advertising or data analytics, which under certain applicable law could be characterized as “selling,” “sharing,” or “targeted advertising.”
IV. JOB APPLICANTS
If you have applied for a job with Baha Mar, we may collect additional personal information from you and third parties, including professional and employment information that we collect through the application you submit, reference checks, and other recruiting and hiring processes. This information will be used, retained, and disclosed for recruiting, compliance, and other human resources purposes, in addition to those purposes described above.
V. ADVERTISING, COOKIES AND SIMILAR TECHNOLOGIES
When you use our online Services, we and our third-party partners (including advertising networks and exchanges, Internet service providers, and data analytics providers) use cookies, pixel tags, local storage, and other similar technologies (collectively, “cookies”) to collect information from your browser or device. By using the Services, you consent to our use of cookies and similar technologies.
•Essential cookies. These cookies are essential to enable you to browse our Services and use certain features. Disabling them may prevent you from using certain parts of the Services. Without these cookies, certain services cannot be provided. These cookies also help keep our Services safe and secure.
•Preference cookies. These cookies store information such as your preferred country and language selection, login data and website preferences. Without these cookies, our Services may not be able to remember certain choices you’ve previously made (such as a saved country / language preference) or personalize your browsing experience by providing you with relevant information. These cookies can also be used to recognize your device so that you do not have to provide the same information more than once.
•Performance cookies. These cookies collect information about how you use our Services such as which pages you visit regularly. These cookies are used to provide you with a high-quality experience by doing things such as tracking page load, site response times, and error messages.
•Content / advertising cookies. These cookies gather information about your use of our Services so we may improve your experience and provide you with more relevant content and advertising on our Services and elsewhere online and across your devices. They are also used to gather feedback on customer satisfaction through surveys. They remember that you’ve visited our Services and help us understand usage of our Services. Some of these cookies are from third parties that collect information about your use of our Services in order to provide advertising (on our Services and elsewhere, across your different devices) based on your online activities (so-called “interest-based advertising”) on our Services and elsewhere online, across your different devices. We do not control the privacy practices of these third parties, and their practices are not covered by this Privacy Policy.
Some mobile and web browsers transmit “do-not-track” signals. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.
VI. MANAGING YOUR PREFERENCES AND INFORMATION
•Commercial E-mails. You may opt out of receiving commercial e-mails from us by following the instructions contained in any of the commercial e-mails. Please note that even if you unsubscribe from certain commercial e-mail messages, we may still e-mail you non-commercial (transactional) e-mails related to your account and your transactions via the Services in accordance with relevant laws. If you wish to opt-out of receiving offers from third parties such as our Hotel Brands, you should follow the instructions in the e-mails that they send you.

VII. YOUR CHOICES
You may have certain rights under applicable data protection laws such as those enforced in the Bahamas (if any). Depending on relevant laws, these may include:
1. Know and Access: You may have the right to request that the specific pieces of information we have collected about you, as well as other information about our processing activities, such as the categories of information we have collected about you, the categories of sources from which the information is collected, the business or commercial purposes for collecting, selling, or disclosing information, and the categories of third parties to whom we disclose information.
2. Data Portability: Subject to certain exceptions, you may have the right to request a copy of the information we collected about you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another entity without hindrance.
3. Correction and Deletion: You may have the right to request that we correct or delete your information in certain circumstances.
4. Opt-Out of Sharing for Targeted Advertising: You may have the right to opt-out of the sale of your information and the processing of your information for targeted advertising. Because the opt-out preference signal is browser-based, note that you will need to enable the signal separately for each browser and/or device from which you would like to be opted-out.
5. Object or Restrict. You may have the right to object to or restrict the processing of your information under certain circumstances, for example objecting to the processing of your information for direct marketing purposes.
6. Opt-Out of Sharing for Direct Marketing. You may have the right to request to “opt-out” of having your information shared with independent affiliates and non-affiliated third parties for their direct marketing purposes.
7. Withdraw Consent. Where our processing of your information is based on consent, you have the right to withdraw consent at any time.
We may not be able to respond if we cannot verify your identity or where we are not required or permitted by applicable law to honor your request. For example, because CTF BM operations is a Bahamian entity, we may not be subject to the laws where you reside.
Only you or a person authorized by you to act on your behalf in accordance with relevant laws (an “authorized agent”) may make a request related to your information. If you are submitting a request through an authorized agent, the authorized agent must confirm their relationship with you. We may request certain information from you to verify your identity before responding to a request. We may also request that any authorized agents verify their identity, including by providing information about themselves, such as their name, email, phone number, and address. We may reach out to you directly to confirm your own identity or that you have provided the agent with your permission to submit the request on your behalf.

While we will not discriminate against you for submitting a request, if you elect not to provide us with certain information, you may not be able to participate in a particular activity, realize a benefit we or the Hotel Brands may offer, or gain access to certain content, functionalities or services in accordance with applicable laws.
VIII. INTERNATIONAL TRANSFERS
By using the Services and providing us with information, you understand and agree that we may transfer and store your information on servers located outside your resident jurisdiction.
Some of the entities (such as third-party vendors) to which we disclose information may be located outside of your resident jurisdiction, including in countries that may not provide the same level of data protection as your home country. We take appropriate steps to ensure that such personnel and third-party vendors are bound to duties of confidentiality, and we will implement measures such as standard data protection contractual clauses to ensure that any transferred information remains protected and secure to the extent required by law.

X. DATA RETENTION, SECURITY, AND INTEGRITY

When determining retention of your information we take into account the length of time personal information is required to be retained to provide the services; to satisfy legal and compliance obligations and for audit purposes; to address any complaints regarding the services; to address any relevant litigation or regulatory investigations; and to defend or bring potential legal claims. Information collected and maintained by our affiliates and Hotel Brands may be subject to a different retention schedule in accordance with their own privacy policies.
We maintain reasonable security measures to safeguard information from loss, theft interference, misuse, unauthorized access, disclosure, alteration, or destruction. We also maintain reasonable procedures to help ensure that such data is reliable for its intended use and is accurate, complete, and current. You should understand that no data storage system or transmission of data over the Internet or any other public network can be guaranteed to be 100 percent secure, accurate, complete, or current. Please note that information collected by third parties may not have the same security protections as information you submit to us, and we are not responsible for protecting the security of such information.
XI.CHANGES TO THE PRIVACY POLICY
We may modify this Privacy Policy from time to time. When we update the Privacy Policy, we will revise the “Effective Date” date above and post the new Privacy Policy. We recommend that you review the Privacy Policy each time you visit the Services to stay informed of our privacy practices.
